Acceptable Use Policy

Prival is a platform used by businesses to communicate with their customers. The way you use that capability matters — to your customers, to carriers and infrastructure providers, and to us. This Acceptable Use Policy (“AUP”) sets the rules for responsible use of the Prival platform. It is incorporated by reference into our Terms of Service. By using the platform, you agree to this AUP.
1. Anti-Spam Commitment
Prival has zero tolerance for spam. All marketing and commercial messages sent through the platform — whether by SMS, email, WhatsApp, or any other channel — must be sent only to recipients who have given clear, documented consent to receive them.
“Consent” means the recipient actively opted in to receive communications from your business, through a verifiable mechanism (a web form, a signed agreement, an in-person opt-in, or equivalent). Pre-checked boxes, purchased contact lists, and scraped contact data do not constitute consent. If you cannot demonstrate that a contact consented to receive your messages, do not send to them.
2. SMS and Email Consent Requirements
2.1 SMS (TCPA)
If you send SMS or MMS messages to contacts in the United States, you must comply with the Telephone Consumer Protection Act (TCPA). This requires:
- Prior express written consent from each recipient before sending marketing messages.
- Clear identification of your business in each message.
- An opt-out mechanism in every marketing message (e.g., “Reply STOP to unsubscribe”).
- Prompt honoring of opt-out requests — no further messages after a contact unsubscribes.
- Compliance with carrier quiet hours (generally no commercial messages before 8 a.m. or after 9 p.m. in the recipient's local time zone).
2.2 Email (CAN-SPAM)
Commercial email sent through Prival must comply with the CAN-SPAM Act and, where applicable, CASL and GDPR. Requirements include:
- Accurate “From,” “To,” and “Reply-To” fields — no deceptive sender information.
- A clear, honest subject line that reflects the content of the message.
- Your valid physical mailing address in every commercial email.
- A functional unsubscribe link in every marketing email, honored within 10 business days of a request.
- No sending to purchased, rented, or harvested email lists without documented consent.
3. Prohibited Content
You may not use the Prival platform to create, store, distribute, or facilitate content that:
- Promotes, incites, or glorifies hatred, discrimination, or violence against any person or group based on race, ethnicity, religion, gender, sexual orientation, disability, or other protected characteristic.
- Is sexually explicit or involves the sexual exploitation of minors in any form.
- Is deceptive, fraudulent, or designed to mislead recipients about the nature, source, or purpose of a communication.
- Impersonates another person, business, or brand without authorization.
- Contains malware, spyware, viruses, phishing links, or any code intended to compromise systems or harvest credentials.
- Violates any applicable law, including export controls, sanctions regulations, or consumer protection laws.
- Infringes the intellectual property rights of any third party.
4. Restricted Industries
The following industries and use cases are not permitted on the Prival platform, either due to regulatory requirements of our infrastructure partners or our own policies:
- Illegal goods or services of any kind
- Cannabis, CBD, and related products (where prohibited by applicable telecommunications carriers or law)
- Payday lending, high-interest short-term credit, and predatory financial products
- Firearms, ammunition, and related accessories (unlicensed)
- Gambling operations that are not licensed in the relevant jurisdiction
- Multi-level marketing (MLM) schemes and pyramid structures
- Any activity classified as “high-risk” under TCPA or carrier guidelines that we have not explicitly pre-approved

5. Prohibited Platform Behaviors
In addition to prohibited content, you may not use the platform to:
- Attempt to gain unauthorized access to other accounts, systems, or networks.
- Conduct load testing, automated scraping, or any activity that places unreasonable strain on shared infrastructure.
- Create multiple accounts to circumvent account limits, suspensions, or our one-claim-per-entity refund guarantee.
- Resell, sublicense, or otherwise make the platform available to third parties as a service without our prior written consent.
6. Consequences of Violation
We take AUP violations seriously. Depending on the nature and severity of the violation, our response may include:
- Warning — for first-time or minor violations, we will notify you and give you the opportunity to correct the issue.
- Feature restriction or suspension — we may temporarily restrict access to specific channels or features while a violation is investigated or remediated.
- Account suspension — for serious or repeated violations, your account may be suspended pending investigation.
- Account termination — for egregious violations, fraudulent activity, illegal content, or violations that put our infrastructure or other customers at risk, we reserve the right to terminate your account immediately without notice and without refund.
We will generally attempt to contact you before taking action, unless the violation requires immediate response to protect other customers or our platform integrity.
7. Reporting Abuse
If you believe that someone is using the Prival platform in violation of this policy — including sending you unsolicited messages, impersonating a business, or engaging in fraud — please report it to us at hello@prival.com. Please include as much detail as possible, including any message content, sender information, and timestamps. We investigate all credible reports.
